1.1 This acceptable use policy (“Acceptable Use Policy”) defines the standards of conduct we require from users of HIVE Telecom’s Broadband service (“HIVE Broadband”). Please refer to the Fair Use Policy at www.HIVE.co.uk for capacity usage guidelines set by us to ensure that all users of HIVE Broadband have access to a reliable service.
1.2 This Acceptable Use Policy forms part of the Terms and Conditions.
1.3 We may change this Acceptable Use Policy from time to time and without further notice to you. Please check this Acceptable Use Policy for updates on a regular basis. If you have any questions about this Acceptable Use Policy or if you wish to notify us of a breach of this Acceptable Use Policy, you can contact Customer Services, whose contact details are set out in the Terms and Conditions.
2. UNLAWFUL ACTIVITIES
2.1 In using any part of the HIVE Broadband service, you must abide by the law applicable to your part of the United Kingdom and not commit or contribute to any offence being carried out.
2.2 This includes not using HIVE Broadband to send, receive, store, distribute, transmit, post or upload or download any materials or data which:
2.2.1 may be deemed illegal, defamatory, abusive, offensive, anti-social, racist, distressing, harmful or threatening;
2.2.2 causes distress, anxiety or harm to another person or that constitute a criminal offence;
2.2.3 breaches any third party’s rights (including rights of privacy, rights of confidentiality, and intellectual property rights such as copyright, database rights, design rights and trade marks);
2.2.4 is or may be harmful to minors;
2.2.5 encourages or promotes illegal or socially unacceptable or irresponsible behaviour;
2.2.6 has any fraudulent purpose or effect or that conceals your identity or impersonates any individual or organisation or otherwise misrepresents yourself as a source of information;
2.2.7 intentionally causes a reduction in performance or functionality of any computer or network facilities;
2.2.8 damages or may damage our name and/or reputation or the name and/or reputation of our suppliers;
2.2.9 constitutes unsolicited bulk mail or ‘spam’; or
2.2.10 subscribes anyone else to a mailing list without his or her authorisation.
3. NETWORK SECURITY
3.1 You must not use HIVE Broadband to violate our network security or any third party’s system or network security by any method including:
3.1.1 gaining or providing access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network without the authorisation of the owner of that network or system;
3.1.2 monitoring data or traffic on any network or system without the authorisation of the owner of that network or system;
3.1.3 interfering with any user, host, system or network without the authorisation of the owner of that network or system;
3.1.4 sending, receiving, storing, distributing, transmitting, posting, uploading or downloading any materials designed to violate our network security or any third party’s system or network security (including but not limited to viruses, worms, corrupted files, hoaxes, Trojan horses, tools designed to compromise the security of other websites’ programs or services designed to send or facilitate the sending of unsolicited advertisements); and
3.1.5 connecting the HIVE Broadband service to insecure machines or services able to be exploited by others to carry out actions which constitute a breach of this Acceptable Use Policy.
3.2 You must not adapt, modify, decompile or reverse engineer any part of the HIVE Broadband service. You are responsible for all materials and/or data originating from the machines and/or networks that you have connected to the HIVE Broadband service. You must immediately disconnect (and subsequently secure prior to reconnection) machines generating materials and/or data which contravene this Acceptable Use Policy once notified of such activity by us or our suppliers.
4. EMAIL ACCOUNTS
4.1 As part of the HIVE Broadband service you may have the ability to use up to a maximum of five email accounts. Each such email account will have a separate email address.
4.2 Each email account should not be in excess of 30MB. Incoming emails may be bounced with a message that states that your account is full should an email account exceed 30MB.
4.3 Where an email account has been deactivated on cancellation of the HIVE Broadband service or otherwise in accordance with the Terms and Conditions (including this Acceptable Use Policy), it will cease to exist and, for a reasonable period thereafter, any incoming mail may be bounced with a message that states that your email account is inactive.
5.1 Do not disclose your username or password to anyone. You are responsible for the security of these.
5.2 We may request that you change your username and/or email address.
5.3 You are responsible for the set-up and security of your computer and any servers that may run on your Computer. You should protect your Computer with anti-virus software and keep your PC updated regularly.
6. USE OF HIVE BROADBAND
6.1 You must use HIVE Broadband in compliance with our instructions regarding health and safety or instructions that are intended to prevent the HIVE Broadband service being disrupted.
6.2 You must be at least 18 years old to be a HIVE Broadband user. Sub-users under this age must have permission from the account holder to access HIVE Broadband. Before using any part of the HIVE Broadband service, you must obtain permission from the person who pays the bill for HIVE Broadband.
7. ACCEPTABLE USE POLICY ENFORCEMENT
7.1 We will block any electronic communication that we reasonably consider to have breached this Acceptable Use Policy.
7.2 If you have breached this Acceptable Use Policy, or we reasonably suspect that you may have breached this Acceptable Use Policy we will notify you by email (provided that this notification does not prejudice any investigation) and we may also:
7.2.1 immediately suspend your access to HIVE Broadband (or any services comprised in the HIVE Broadband service, including without limitation email accounts until such time as we are satisfied the breach has stopped;
7.2.2 cancel HIVE Broadband in accordance with the Terms and Conditions;
7.2.3 notify and/or pass on the details of the breach of the Acceptable Use Policy to any relevant government, statutory, self-regulatory or law enforcement authority;
7.2.4 investigate the alleged breach of the Acceptable Use Policy, which may include gathering information from you and/or the complaining party (if any) and the examination of any other data or other material on the network or our servers; and/or
7.2.5 remove (either temporarily or permanently), copy, store, monitor or otherwise deal with data and/or other material on the network or our servers.
8. ACCEPTABLE TELECOMS USE
8.1 You will at all times use the HIVE Calls service in a responsible manner. If as a result of Police action or investigation by the Nuisance Call Bureau we reasonably conclude that your conduct when using our Calls Service is unlawful, harmful to others or unacceptable on grounds harassment or public decency we reserve the right to immediately restrict or modify the phone service available to you. Such restrictions may be applied to your account on a temporary or permanent basis.
8.2 Where the act harm, indecency or harassment is sufficiently serious that criminal prosecution is likely we reserve the right to terminate your agreement forthwith, and without notice.
